Carrick Acceptable Use Policy

The Carrick Health messaging platform is a cloud-based solution designed to enhance communication across various sectors. To ensure responsible usage and compliance with legal requirements, all users are required to adhere to this Acceptable Use Policy (AUP). This document outlines the necessary guidelines for obtaining consent, respecting privacy, ensuring transparency, and maintaining compliance with applicable laws.

Adequate Consent

Acquiring Consent

Users must obtain express consent from each recipient before sending any messages through the Carrick platform. Consent should be clear, unambiguous, and documented. However, there are exceptions to this requirement:

  • Inbound Contact Exception: If a contact initiates communication with you or your organization first, you may reply to their inquiries or provide information as requested without obtaining additional express consent.

  • Existing Relationship Transactional Exception: If you have a pre-existing relationship with a contact, you may send them transactional text messages related to that relationship without obtaining additional express consent. Examples of transactional messages include appointment reminders, billing information, and service updates.

Note: This exception does not apply to messages with marketing or promotional content. Users are encouraged to apply specific tags to contacts to reflect the type of consent provided. For example, tags can differentiate contacts who have consented to receive marketing messages from those who are only to receive transactional communications.

Respect for Privacy

Even under these exceptions, users must respect the privacy of the contact and provide a clear option to opt out of receiving further communications.

Identification and Transparency

Clear Identification

Every message sent through Carrick must clearly identify the sending organization or individual.

Accurate Representation

Users must never impersonate another person or organization or send messages that may be misleading as to their origin.

Opt-Out Mechanism

Providing Opt-Out Options

Your first outbound message to an individual should include a simple and straightforward instruction for recipients to opt out of receiving future messages. To opt out, a contact must simply reply to your message with the word “STOP.” Once opted out, they will be removed from your contact list and cannot be reached through SMS or MMS from your Carrick number.

Usage Limitations

Prohibited Content

Messages containing illegal, fraudulent, defamatory, abusive, threatening, obscene, or otherwise objectionable content are strictly prohibited.

Compliance with Laws

Users must use Carrick services in a manner that complies with all applicable laws, regulations, and industry standards, including but not limited to the Telephone Consumer Protection Act (TCPA), General Data Protection Regulation (GDPR), and anti-spam legislation.

Harmful Actions

Users must not use Carrick for harmful activities such as spreading malware, phishing for sensitive information, or engaging in fraudulent schemes.

Spamming

Users must refrain from spamming or sending unsolicited messages to recipients who have not provided express consent.

Enforcement and Violations

Carrick reserves the right to monitor the usage of its platform to ensure compliance with this AUP. Violations of this policy may result in suspension or termination of service and may expose the user to legal penalties.
